By accessing or using our website or services, you agree to be bound by these Terms of Use. If you do not agree with these Terms, you should not use the relevant services.

About These Terms

These Terms are intended to establish the rules and conditions governing the use of the Hacksparrow platform and services.

Hacksparrow provides a platform through which training, professional services, consultancy, technology services, and Trainer-related services may be offered.

Some training programs may be delivered directly through Hacksparrow, while others may be delivered by independent Trainers operating through the platform.

Eligibility

Hacksparrow services are intended for individuals aged 16 years or older.

By using our services, you confirm that you meet the applicable minimum age requirement and that the information you provide to us is accurate to the best of your knowledge.

If you are using Hacksparrow on behalf of a business or organisation, you confirm that you have the authority to act on behalf of that organisation.

Use of the Website

You agree to use the Hacksparrow website only for lawful purposes and in a manner that does not interfere with the operation, security, or availability of the website or services.

You must not:

• Use the website for unlawful or fraudulent purposes
• Attempt to gain unauthorised access to accounts or systems
• Impersonate another person or organisation
• Provide false or misleading information
• Upload malicious software, code, or harmful content
• Attempt to compromise the security of the platform

Trainer Accounts

Account creation on the Hacksparrow platform is currently available to Trainers.

Individuals who wish to become Trainers must complete the required application process and provide the information requested by Hacksparrow.

Hacksparrow may review the applicant’s identity, professional background, qualifications, experience, CV, profile information, and other relevant information before approving a Trainer account.

The purpose of this process is to help verify that Trainers are genuine individuals and to reduce the risk of fraud, impersonation, misleading information, or harm to students and other users.

Accuracy of Trainer Information

Trainers are responsible for ensuring that all information submitted to Hacksparrow is accurate, current, and not misleading.

A Trainer must not provide false qualifications, certificates, professional experience, identity information, or any other information intended to mislead Hacksparrow or students.

Hacksparrow may request additional information or documentation where reasonably necessary to verify a Trainer’s identity, background, qualifications, or professional information.

Trainer Approval

Approval as a Trainer on Hacksparrow means that the Trainer has successfully passed the platform’s review and onboarding process.

Hacksparrow does not represent that every approved Trainer holds a government-issued licence, academic qualification, professional licence, or external professional accreditation unless this is expressly stated and independently verifiable.

Hacksparrow is not itself an academic or government accreditation authority merely because a Trainer has been approved to use the platform.

Trainer Subscription

Trainers may be required to purchase a subscription in order to create or maintain an active Trainer account and access Trainer-related features.

The applicable subscription price, duration, features, and conditions will be displayed on the website or communicated to the Trainer before payment.

A Trainer’s access to certain platform features may depend on maintaining an active subscription.

Subscription Cancellation or Expiration

A Trainer may cancel their subscription subject to the conditions applicable to the relevant subscription.

When a Trainer subscription expires or is cancelled, the Trainer may lose access to features that require an active subscription, including the ability to issue new certificates through the platform.

Certificates that were legitimately issued before the subscription ended may remain available for verification, subject to the applicable certificate rules and any legitimate reason for withdrawal or invalidation.

Training Programs

Hacksparrow may provide or facilitate access to training programs delivered online.

Training may be delivered through live online sessions, including sessions conducted using platforms such as Zoom, or through Trainers operating independently through the Hacksparrow platform.

Training programs may be announced from time to time and may vary in subject, duration, schedule, Trainer, price, delivery method, and other conditions.

Live Training

Where a live training program is offered, the applicable information regarding the program, including its schedule, Trainer, price, duration, and requirements, will be provided at the time of announcement or registration.

Hacksparrow may modify, postpone, reschedule, or cancel a training program where reasonably necessary, including where there are operational, technical, scheduling, or other legitimate reasons.

Independent Trainers

Some training programs may be delivered by independent Trainers.

Independent Trainers are responsible for the content, delivery, teaching methods, professional representations, and other aspects of the training they provide, subject to the requirements of Hacksparrow and applicable law.

Where appropriate, Hacksparrow may take action against a Trainer if information provided by the Trainer is found to be false, misleading, fraudulent, or otherwise inconsistent with these Terms.

Trainer Responsibilities

Trainers using Hacksparrow agree to provide training and services in a professional, lawful, respectful, and honest manner.

Trainers must:

• Provide accurate professional information
• Provide training that corresponds reasonably to the advertised subject
• Use appropriate and lawful educational materials
• Treat students respectfully
• Avoid discriminatory, abusive, threatening, or inappropriate behaviour
• Respect intellectual property rights
• Protect confidential student information
• Not engage in fraudulent activity
• Not make misleading claims regarding qualifications or accreditation
• Comply with applicable laws and regulations

Course Content

Training materials, presentations, documents, videos, software, graphics, text, exercises, and other educational materials may be protected by intellectual property laws.

Unless expressly permitted by the relevant rights holder, users must not reproduce, redistribute, sell, publish, upload, or commercially exploit training materials without permission.

Trainers are responsible for ensuring that materials they upload or use in connection with their training do not infringe the intellectual property, privacy, or other legal rights of third parties.

Certificates

Hacksparrow may provide Certificates of Completion for eligible training programs where the applicable requirements have been successfully completed.

A certificate may contain information such as:

• Recipient’s name
• Course or training title
• Trainer name
• Training dates
• Certificate number
• QR verification code
• Certificate status

Certificate Requirements

A certificate does not automatically confirm that a recipient has obtained a government, academic, or professional qualification.

A Certificate of Completion generally confirms that the relevant training program was completed according to the requirements established for that program.

Where applicable, the Trainer may assess the student’s performance or completion of the training requirements.

Certificate Verification

Hacksparrow may provide an online certificate verification system that allows a person to verify a certificate without creating an account.

Verification may be performed using a certificate number, QR code, or another verification identifier.

Hacksparrow reserves the right to mark a certificate as invalid, cancelled, withdrawn, or otherwise unavailable for verification where there is a legitimate reason to do so.

Payments

Payments for applicable Hacksparrow services may be processed through Stripe or another payment provider specified by Hacksparrow.

By making a payment, you agree to provide accurate payment and billing information and to use a valid payment method that you are authorised to use.

Prices displayed on the website may vary depending on the service, Trainer, training program, subscription, location, taxes, or other applicable factors.

Trainer Course Fees and Commission

Where Hacksparrow advertises or facilitates a live training program offered by a Trainer, Hacksparrow may charge a commission or other agreed fee in connection with registrations for that program.

The applicable commission or financial arrangement may be agreed with or communicated to the Trainer before the relevant training program is launched.

There is no requirement for Hacksparrow to apply a minimum number of students unless a specific training agreement states otherwise.

Refunds

Refunds may be available in accordance with the specific service, subscription, training program, applicable law, and any refund terms communicated at the time of purchase.

Trainers who request a refund relating to a subscription or applicable payment should contact Hacksparrow and provide the relevant transaction information.

Refund requests may be reviewed by Hacksparrow before a refund is approved.

Where a refund is approved, the refund may normally be processed through the original payment method or through another method reasonably determined by Hacksparrow.

Nothing in these Terms limits any mandatory consumer rights that cannot lawfully be excluded or restricted.

Pricing and Service Changes

Hacksparrow reserves the right to change prices, subscription plans, services, features, commission arrangements, or other commercial terms from time to time.

Changes will generally apply to future purchases or renewals unless otherwise required by law or expressly agreed with the relevant customer or Trainer.

User Reviews and Ratings

Where the platform provides ratings or reviews for Trainers, such ratings may be based on feedback submitted by students or other eligible users.

Reviews should be honest, relevant, respectful, and based on genuine experience.

Users must not submit fake reviews, manipulate ratings, threaten others to obtain positive reviews, or use reviews to harass or defame another person.

Hacksparrow may remove or restrict reviews that violate these Terms, applicable law, or reasonable platform standards.

Intellectual Property

Unless otherwise stated, the Hacksparrow website, platform, branding, logos, designs, software, text, graphics, layout, and other original materials provided by Hacksparrow are owned by or licensed to Hacksparrow Ltd.

Nothing in these Terms grants you ownership of Hacksparrow intellectual property.

You may not copy, reproduce, modify, distribute, sell, license, or commercially exploit Hacksparrow materials without prior written permission unless expressly permitted by law.

Trainer Content and Licence

Trainers retain ownership of intellectual property that they lawfully own and provide to the platform.

By submitting content to Hacksparrow for the purpose of operating, promoting, displaying, or delivering a training program, the Trainer grants Hacksparrow a non-exclusive permission to use that content to the extent reasonably necessary to provide and promote the relevant service.

This permission does not transfer ownership of the Trainer’s intellectual property to Hacksparrow.

Trainers must ensure that they have the necessary rights and permissions to use any content they submit or provide through the platform.

Prohibited Content and Activities

The Hacksparrow platform must not be used to provide, promote, distribute, or facilitate unlawful or harmful activities.

Prohibited activities include:

• Fraud or attempted fraud
• Identity theft or impersonation
• Providing false professional qualifications
• Misleading students
• Harassment or abuse
• Discrimination
• Malicious software or cyber attacks
• Copyright or intellectual property infringement
• Unauthorised collection of personal information
• Illegal financial activities
• Any activity that violates applicable law

Suspension and Termination

Hacksparrow may suspend, restrict, or terminate an account or access to services where we reasonably believe that a user or Trainer has violated these Terms, applicable law, or the security or integrity of the platform.

This may occur in circumstances including:

• Fraudulent or misleading information
• Failure to provide requested verification information
• Fraudulent payment activity
• Serious complaints or misconduct
• Violation of intellectual property rights
• Abuse of students, Trainers, or staff
• Attempts to compromise platform security
• Repeated violations of these Terms
• Conduct that creates a significant risk to Hacksparrow or its users

Where appropriate, Hacksparrow may provide an opportunity to resolve an issue before taking further action. However, immediate suspension may be necessary where there is a security, fraud, legal, or safety concern.

Trainer Account Closure

A Trainer may request the closure of their account by contacting Hacksparrow.

Closing a Trainer account does not necessarily result in the deletion of all information associated with that account.

Hacksparrow may retain information where necessary for legal, accounting, security, fraud prevention, certificate verification, dispute resolution, or other legitimate purposes.

Third-Party Services

Hacksparrow may use third-party services to operate and provide certain aspects of the platform.

These may include payment providers, video conferencing services, hosting providers, email providers, security services, analytics services, and other technology providers.

Your use of a third-party service may also be subject to that provider’s own terms and privacy policy.

Third-Party Links

The website may contain links to websites or services operated by third parties.

These links are provided for convenience or informational purposes.

Hacksparrow does not control third-party websites and is not responsible for their content, availability, security, terms, or privacy practices.

Disclaimer

Training and consultancy services are provided for educational, professional, informational, or practical purposes and should not automatically be considered legal, financial, medical, investment, or other regulated professional advice.

Trainer Independence

Trainers operating independently through Hacksparrow are responsible for the professional content and services they provide.

Unless expressly stated otherwise, the presence of a Trainer on the Hacksparrow platform does not mean that Hacksparrow guarantees every statement, opinion, recommendation, qualification, or professional claim made by that Trainer.

Hacksparrow may take reasonable action where a Trainer violates these Terms or provides false or misleading information.

Limitation of Liability

To the extent permitted by applicable law, Hacksparrow Ltd shall not be responsible for losses that arise from matters outside our reasonable control, including interruptions caused by third-party services, internet failures, technical problems, or events beyond our reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Nothing in these Terms is intended to exclude or limit any mandatory statutory rights that cannot lawfully be excluded.

Indemnity

To the extent permitted by applicable law, a user or Trainer may be responsible for losses, claims, liabilities, costs, or expenses arising from their unlawful use of the platform, violation of these Terms, infringement of third-party rights, fraud, or misuse of the services.

Availability of the Platform

We aim to keep the Hacksparrow website and services available; however, continuous or uninterrupted availability cannot be guaranteed.

The website may occasionally be unavailable due to maintenance, technical issues, security measures, updates, hosting problems, or circumstances beyond our control.
